Agitated callback from someone who received a flyer

…The U.S. Code for crimes and criminal procedure prohibits the placement of unstamped flyers in any mailbox. Title 18, section 1725 states that any person who knowingly deposits “mail-able matter” without postage in an established letter box shall be subject to a fine.

The Government Accountability Office reports that fines may be as high as $5,000 per occurrence for individuals and $10,000 per occurrence for organizations.

This law is commonly known as the “mailbox restriction.”

The restriction also includes anything placed upon, supported by, attached to, hung from, or inserted into a mail receptacle.

So, interestingly enough, it looks like the call may have come from an ignorant newbie postal carrier. The local post office called and said their post carrier brought some of my flyers back and said they were in mailboxes. I explained that I put them in newspaper boxes only, and he said that was just fine. He was a real nice guy about it. He said he would question the postal carrier next time he saw him.

If you are delivering flyers to newspaper boxes might as well just get door hangers and do those instead - same delivery system and doesn’t get lost in the mix of all of the other “junk mail”. Stand out!

Pbbb please, you didn’t offend me. Fact of the matter is, an irresponsible gun owner who shoots someone for leaving a flyer at their property is going to jail for murder. Plain and simple.

I did not say I would shoot someone for leaving a flier on my property. Please people of this world stop Mia reading everyone’s post and misconstruing information and re writing it for your benefit of the argument.

I said someone who walks on my property line and goes to my front porch where my mail box hangs, and touches it, after ignoring my no trespassing signs, and is invading my privacy and property, I have every legal right to shoot the person.

I also never said shoot them dead, or murder. Not like I planned for that person to “rob” me.

Uhm I’m not sure what to say here? Maybe go read some city/state/federal laws before insulting me and “quoting” the laws set in place.

Don’t worry every single person on these forums say very smart and great things, but we’ve also been wrong and dumb plenty of times. :slight_smile: I do it constantly, and I learn so much from it!

I am 100% for gun rights and access, it is people like you who make it hard for those of us who know the laws and our responsibilities to carry and protect ourselfs.

and anyone properly trained and is responsible knows that when that weapon is drawn it isnt too maim or wound but too completely remove a threat in a life and death situation

Someone walking up to your mailbox and leaving a flier may be trespassing, but that is not a life threatening act. If you are foolish enough to shoot someone for that, you WILL be charged with murder. I don’t care what state you live in.

I’m sorry, but ANYONE who thinks it’s “your right” to shoot someone leaving a flier, deserves to be stripped of the right to own or use guns. There is an obvious mental defect in that kind of person’s brain. Maybe you are the kind of guy who’s actually shoot a JW that stops in to share there religious views as well?

Man, you really need to seek out help before you hurt or kill someone.

Any tool or weapon can be used to kill or temporarily disable someone, including a gun.

I’m not meaning to offend anyone here and I think these text are not ettibgnmy true meaning across. I am not at all advocating that someone should sit there watch my 32 cameras and the moment I see someone on my property I go shoot them.

I said if they ignore every sign and possible warning I have a RIGHT to do what I must to protect my family. Obviously a guy walking up and putting a flier in my mailbox may irritate me beyond belief especially since I have 3 signs explaining about no soliciting of any kind except a door hanger.

But I wouldn’t shoot them.

But a guy/person who has stolen over 12 packages off my porch who broke into my mailbox multiple times to steal information. I have every legal right to protect my property. Especially me being a small guy, I prefer to use my MMA. I have no plans to kill a human or defenseless animals ever.

Can’t wait to see how you guys re write all that and still make me an evil person… why do I even bother talking on these forums? All I ever learn lately is how to treat each other like shit.

You got 32 cameras, yet you can’t catch the guy? (you have more cameras than most stores. I bet you have a HUGE computer with monster back up storage too, right?)

MMA fighter? I said I know mixed martial arts? Damn good guess on the weight though although I’ve gotten it now closer to 113 and trying to hit 125 by next year.

I added the Door hangers Okay after my family and friends laughed at me for putting door hangers on home and having so many no soliciting signs.

Yep I have so much video I’ve showed authorities and some awesome facial shots… different people throughout the years. Caught a few most get away.

Crime is getting worse everywhere and here’s all of us, starting fights over EVERYTHING.

That is probably why they had to amend it later to include the post and flag, because the original law had that technicality restricting the violation to people opening the mailbox flap and putting it in the mailbox.

Yeah, Blue Lightning had already updated me on that change.

That angry caller may have went back and put them in the mailboxes trying to get you in trouble, or it may have been a competitor who saw you flyer when he was canvassing.

Yeah, ignoring the signs is not grounds for any physical action because they may be dyslexic and not able to read the sign. Taking the packages is not really grounds for physical action either because it is non threatening. However, placing something in your box is can be deemed as a threat and an attempt to do harm because you don’t know if they are putting in a bomb, a rattlesnake, or even something less obvious and more subtle like anthrax. Since the action itself is illegal then the assumption of ill intent could be deemed as understandable and justified. All interpretation of the law rests finally in the Judges hands.

It seems apparent that some of you would GREATLY benefit from actual gun training. This keyboard commando “you can shoot them if they do this” is dumb.

You can’t shoot someone just because they trespassed on your property. You can’t shoot someone because they illegally put something in your mailbox. You should never shoot to wound, as that leave you open to criminal and civil liabilities.

For being a group of people who are supposed to be smarter than the average person, some of you are woefully uneducated and like passing along bad information (Insert FAKE NEWS meme here). One would think the taking of a life would be something we would NOT want to do unless we were put in the situation to have no other choice. I know I sure would NOT want to have to carry that on my conscious for the rest of my life. It sure isn’t something to brag about IMO.

If someone were trespassing or messing with my mailbox, I’d FIRST call the cops, or get a big, smelly stick to chase them with. My first reaction to someone doing something dumb isn’t to kill them or mame them. I’m not a psyco or mentally ill…
