From my experience insurance companies will always look for a reason not to pay.

You can drink and drive, being over the limit get into an auto accident , insurance covers the damage.

An employee can be violate safety guidelines causing a fall, workmanship comp covers for their injury.

If insurance claims were determined to be valid or not were based on if they could have been prevented would eliminate most claims.
That’s why insurance is risk based.

If many scratch claims are made by window cleaners, this will increase rates for the industry.
